A person who intentionally puts another in the reasonable belief of imminent physical harm or offensive contact.
An assault is committed when someone “engages in conduct which places another in reasonable apprehension of receiving a battery.” It’s a threat—real or implied—of a battery, or an incomplete battery.

Penal Code (1)02 - is a misdemeanor punishable by no less than 5 minutes in holding and no more than 10 minutes in holding. Fine $1500.
